These Terms of Service ("Terms") govern your access to and use of the Banana Stand mobile application (Android package name: io.monkedao.bs; iOS bundle identifier: io.monkedao.bs), the Banana Stand web application available at https://bananastand.monkedao.io, and any related services (collectively, the "Services").

The Services are developed, published, and operated by MONKE BUSINESS ("we," "our," or "us") under the MonkeDAO brand.

By creating an account, accessing, or using the Services, you agree to these Terms. If you do not agree, you must not access or use the Services.

1. Eligibility

To use the Services, you must:

• Be at least 13 years of age, or the minimum legal age required in your jurisdiction;

• Have the legal capacity to enter into a binding agreement;

• Comply with all applicable laws and regulations.

If you use the Services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. About Banana Stand

Banana Stand is a community platform operated under the MonkeDAO brand.

The Services are designed to help members participate in community activities and may include:

• User profiles

• Quests

• XP and progression

• Badges and achievements

• Community events

• Local Chapters

• Leaderboards

• Announcements

• Other community engagement features

Banana Stand is not a cryptocurrency exchange, digital wallet, financial institution, investment platform, payment processor, or custodial service.

3. User Accounts

Certain features require you to create an account and authenticate using supported third-party providers.

You are responsible for:

• Maintaining accurate account information;

• Protecting access to your account;

• All activities performed using your account.

You must notify us immediately if you believe your account has been compromised.

4. Authentication

Banana Stand may use third-party authentication providers, including Discord, X (formerly Twitter), and other supported services.

Authentication is used solely to:

• Verify your identity;

• Authenticate access to the Services;

• Enable community features.

Your use of third-party authentication services remains subject to their respective terms and privacy policies.

5. Community Verification

To verify eligibility for community features, Banana Stand may store one or more public Solana wallet addresses associated with your account.

Wallet addresses may be used to:

• Verify community membership;

• Verify NFT ownership where applicable;

• Determine eligibility for quests, badges, events, rewards, and other community features.

Banana Stand does not:

• Access your wallet;

• Request transaction approvals;

• Initiate blockchain transactions;

• Store private keys;

• Store recovery phrases;

• Store wallet passwords.

You remain solely responsible for your wallet and any digital assets associated with it.

6. Community Profiles

Your Banana Stand profile may include information that you voluntarily provide, including:

• Username

• Display name

• Profile picture

• Biography

• Country

• City

• Local Chapter

• XP

• Badges

• Achievements

Depending on your privacy settings and participation in community features, portions of your profile may be visible to other users.

7. Community Features

Banana Stand may offer features including:

• Quests

• Leaderboards

• XP

• Badges

• Community events

• Local Chapter participation

• Profile customization

• Community campaigns

Features may change over time.

MONKE BUSINESS reserves the right to modify, suspend, or discontinue any feature without prior notice.

Participation in community activities does not guarantee future rewards, benefits, or continued availability of any feature.

8. Acceptable Use

You agree that you will not:

• Violate any applicable law;

• Impersonate another individual or organization;

• Create multiple accounts to gain an unfair advantage;

• Manipulate quests, XP, badges, achievements, or leaderboards;

• Submit false or misleading information;

• Interfere with the operation or security of the Services;

• Attempt unauthorized access to any system or account;

• Use bots, scripts, or automation except where expressly permitted;

• Upload malicious software or code;

• Harass, threaten, or abuse other users;

• Exploit bugs or vulnerabilities.

Violation of these Terms may result in suspension or permanent termination of your account.

9. User Content

You retain ownership of any content you submit through Banana Stand.

By submitting content, including profile information, biographies, images, or other materials, you grant MONKE BUSINESS a worldwide, non-exclusive, royalty-free license to use, reproduce, display, and distribute that content solely for the purpose of operating, maintaining, improving, and promoting the Services.

You represent that you have all necessary rights to submit such content.

10. Intellectual Property

Unless otherwise stated, all intellectual property rights relating to the Services, including:

• Software

• User interface

• Graphics

• Logos

• Trademarks

• Icons

• Text

• Documentation

• Design elements

are owned by MONKE BUSINESS or its licensors.

Nothing in these Terms grants you ownership of any intellectual property.

You may not copy, modify, distribute, reverse engineer, or create derivative works from any portion of the Services except where permitted by applicable law.

11. Third-Party Services

The Services may integrate with third-party providers including:

• Discord

• X (formerly Twitter)

• Matrica

Your use of those services is governed by their own terms and privacy policies.

MONKE BUSINESS is not responsible for the availability, security, or practices of third-party services.

12. Availability

We strive to provide reliable Services but cannot guarantee uninterrupted availability.

The Services may be temporarily unavailable due to:

• Maintenance;

• Software updates;

• Security incidents;

• Infrastructure failures;

• Third-party outages;

• Events beyond our reasonable control.

13. Suspension and Termination

We may suspend or terminate your access to the Services if we reasonably believe that you:

• Violated these Terms;

• Engaged in fraudulent or abusive behavior;

• Compromised the security of the Services;

• Used the Services unlawfully.

Termination may result in the removal of your account, profile, XP, badges, achievements, quest history, and access to community features.

14. Disclaimer of Warranties

The Services are provided on an "AS IS" and "AS AVAILABLE" basis.

To the maximum extent permitted by law, MONKE BUSINESS disclaims all warranties, whether express or implied, including warranties of:

• Merchantability;

• Fitness for a particular purpose;

• Non-infringement;

• Availability;

• Accuracy;

• Reliability.

We do not warrant that the Services will always operate without interruption or error.

15. Limitation of Liability

To the fullest extent permitted by law, MONKE BUSINESS, its affiliates, officers, employees, licensors, contributors, contractors, and partners shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from your use of the Services.

Our total liability shall not exceed the greater of:

• USD $100; or

• The total amount paid by you directly to MONKE BUSINESS for the Services during the preceding twelve (12) months.

16. Indemnification

You agree to indemnify and hold harmless MONKE BUSINESS, its affiliates, officers, employees, licensors, contractors, and partners from any claims, damages, liabilities, costs, or expenses arising out of:

• Your use of the Services;

• Your violation of these Terms;

• Your violation of applicable law;

• Your infringement of any third-party rights.

17. Privacy

Your use of the Services is also governed by the Banana Stand Privacy Policy, which is incorporated into these Terms by reference.

18. Changes to the Services

We may introduce new features, improve existing functionality, or discontinue portions of the Services at any time.

Where appropriate, we may provide advance notice of significant changes.

19. Changes to These Terms

We may revise these Terms from time to time.

When we make material changes, we will update the Effective Date shown above.

Your continued use of the Services after revised Terms become effective constitutes acceptance of the updated Terms.

20. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws applicable to MONKE BUSINESS, without regard to conflict of law principles.

Any dispute arising from these Terms or the Services shall be subject to the exclusive jurisdiction of the competent courts, unless otherwise required by applicable law.

21. Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

22. Entire Agreement

These Terms, together with the Privacy Policy and any additional policies referenced by the Services, constitute the entire agreement between you and MONKE BUSINESS regarding your use of Banana Stand.
